In a recent decision from the 10th Circuit, the Court ruled against Wal-Mart/Sam’s Club, and affirmed a jury’s verdict finding that the Company had engaged in age discrimination by failing to promote. The Age Discrimination in Employment Act, known as ADEA, makes it unlawful for an employer to “discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s age.” 29 U.S.C. § 623(a)(1).
