New York State will pay the medical bills of babies who suffer brain injuries during birth.
A new “neurological fund” created in New York State’s budget will cover newborns who suffer spinal cord and brain injury due to oxygen deprivation or mechanical injury during labor, delivery or resuscitation.
Families will still have to file lawsuits and prove medical negligence in court, but families that win will receive payment for lifetime medical costs from the state.
Hospital Associations, who advocated for the fund, say the new fund will save an estimated 320 million dollars in medical malpractice premiums.
