The Vioxx litigation continues to produce verdicts. Some strongly favor the victims of this withdrawn drug. Others in favor of the manufacturer. My observation would be that the manufacturer cannot win enough of the cases to make it worthwhile to try all or even many of the cases.

–April 5, 2006: A jury in Atlantic City, N.J., finds Merck liable for New Jersey resident John McDarby’s non-fatal heart attack, but not for fellow plaintiff Thomas Cona. The jury awarded McDarby $4.5 million in compensatory damages.
