On February 8, a 61-year-old man was crossing Rainier Avenue South in a crosswalk with the light when he was struck and killed by a car. The car was turning from Holly Street South onto Rainier Avenue South.
RCW 46.62.261 requires that all drivers shall yield the right of way to any pedestrian. Therefore, injured pedestrians may not be barred from recovering damages even if drivers were following posted speed limits. Pedestrians struck by motor vehicles may not only recover under the driver’s liability policy, but also the driver’s personal injury protection (PIP) policy.
