A Kentucky woman, Geneva Hager, sought to represent a class of car accident victims in a suit against Allstate Insurance Co. The plaintiff claims that Allstate “illegally employ[s] various schemes and delay tactics to bully car accident victims into accepting lowball offers for their pain and suffering.” The judge denied the woman’s request to represent a class of victims because the facts of her case were too unique to be representative. However, the ruling left open the possibility that such a class action lawsuit challenging the way Allstate handles car accident claims could proceed with another accident victim representing the class. Meanwhile, Ms. Hager’s individual lawsuit will proceed against Allstate.
