As reported in the National Law Journal study, plaintiffs who went to trial in their lawsuits in 2005 won 68% of the time in front of judges and 54% of the time in front of juries. The median jury award was $28,000.00 which has dropped from earlier studies, and the number of cases actually going to trial has also dropped. The report was based on statistics compiled by the US Department of Justice.
