If the initial reports are accurate, and if the coroner has ruled Michael Jackson’s death to be a homicide, the obvious question that probably won’t be asked is; why aren’t many more cases of medical negligence also ruled as homicides? Certainly, the doctor who delivered the lethal doses of those drugs did not do so with malicious intent. Negligent homicide is a crime that does not require malicious intent. It seems to me that when any patient, not just a celebrity, is killed through egregious negligence it should be labeled a homicide and those responsible should be prosecuted under criminal law.

Where, then, would that leave institutions that have allowed MRSA and VRE, etc., to proliferate uncontrolled for decades?
