There will be a new way to file Zofran birth defect lawsuits, and several families have already used it to make their voices heard in a growing litigation against pharmaceutical giant GlaxoSmithKline.

Zofran Birth Defect Lawsuit Filing Gets A Speed-Up

Instead of writing their own lengthy individual complaints, parents will soon have the opportunity to work from a “Master Complaint,” which brings together all of the core allegations leveled against Zofran’s manufacturer. On an accompanying “Short Form Complaint,” new Plaintiffs will be able to adopt allegations outlined in the Master Complaint by checking boxes. In one of the first lawsuits to be submitted using the new technique, a mother from Sandusky, Ohio claims her son, born in 2006, developed a range of heart and facial defects after continuous prenatal exposure to Zofran. The child, named as LG, lives with an atrial septal defect, ventricular septal defect and cleft palate, according to Plaintiff’s Short Form Complaint. The mother also claims her child has suffered “issues with vision and hearing,” likely as a result of her cleft palate.

The family’s lawsuit was filed on June 24, 2016 under the case number 1:16-cv-11281-FDS.
