U.S. District Court Judge Eldon Fallon rejected Vioxx maker, Merck & Co’s, request to throw out 2 lawsuits against them in regards to Vioxx. Judge Fallon has thrown out the Motions for Summary Judgments that Merck filed.
This is a great victory for plaintiff’s and not surprisingly Merck does not support the decision made by the judge and is planning to appeal. Merck is facing more than 27,000 lawsuits related to the use of Vioxx as it was shown to cause an increased risk of heart attack and stroke. I am anxious to see what else awaits in this ongoing litigation. So far, it has been a complete showdown.
