A man, who says his dog has helped him to cope with the after effects of the World Trade Center attack, is fighting his condo neighbors whom are trying to evict his German shepherd.

Marvin got his dog, Jazzman, as a recommendation for therapy. Neighbors complain the dog is bigger than allowed by the condo code that limits the size of dogs to no bigger than 35 pounds. They also say the dog has attacked another dog.

Tuesday, the Deer Run Condominium Association Sued.

Marvin, 39, was working in the World Trade Center on September 11, 2001, when the twin towers were attacked. He has had a hard time dealing with the overwhelming stress and counselors had suggested a dog might help.

He has 28 days to respond to the complaint. A hearing will than be set in Butler County Common Pleas Court.
